Acceptance of Terms

Welcome to Lunar Catalyst. These Terms of Service ("Terms") govern your use of our fitness facilities, services, and website operated by Lunar Catalyst B.V., a company registered in the Netherlands with registration number 97349608, located at Berkenlaan 48, 1354 BW Almere, Netherlands.

By accessing our facilities, using our services, or visiting our website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services or facilities.

These Terms constitute a legally binding agreement between you and Lunar Catalyst. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on our website.

Membership and Services

Membership Eligibility

To become a member of Lunar Catalyst, you must be at least 16 years of age. Members under 18 years of age require written parental consent. All members must complete our health questionnaire and provide valid identification upon registration.

Membership Types and Fees

We offer various membership plans as detailed on our website and in our facility. Membership fees are payable in advance and are non-refundable except as expressly provided in these Terms or required by applicable law.

• Monthly membership fees are due on the same date each month
• Annual memberships are due in full at the time of registration or renewal
• Additional fees may apply for personal training, special classes, or premium services
• All fees are quoted in Euros and include applicable VAT where required

Facility Access

Members have access to our facilities 24 hours a day, 7 days a week, subject to these Terms and our facility rules. Access is granted through membership cards or electronic access systems, which remain the property of Lunar Catalyst.

Member Obligations and Conduct

Health and Safety

• You must disclose any medical conditions that may affect your ability to exercise safely
• You exercise at your own risk and should consult with healthcare professionals before beginning any fitness programme
• You must follow all posted safety guidelines and equipment instructions
• You agree to use equipment properly and report any damaged or malfunctioning equipment immediately

Facility Rules

• Appropriate athletic attire and closed-toe shoes are required at all times
• Members must clean equipment after use and return weights to designated areas
• Personal belongings must be stored in lockers; Lunar Catalyst is not responsible for lost or stolen items
• Photography, videography, or recording is prohibited without written permission
• Disruptive behaviour, harassment, or inappropriate conduct will result in membership termination
• Smoking, alcohol consumption, and illegal substances are strictly prohibited

Guest Policy

Guest privileges vary by membership type and are subject to availability. All guests must be accompanied by the member, complete a waiver, and pay applicable guest fees. Members are responsible for their guests' conduct and compliance with facility rules.

Payment and Billing

Payment Methods

We accept various payment methods including bank transfers, direct debit, and major credit cards. By providing payment information, you authorise us to charge applicable fees according to your membership agreement.

Late Payments and Suspension

If payment is not received within 7 days of the due date, your membership may be suspended, and you may be charged late fees. Continued non-payment may result in membership termination and collection proceedings.

Refund Policy

Membership fees are generally non-refundable. However, we may provide refunds in cases of serious illness, permanent relocation outside our service area, or as required by Dutch consumer protection laws.

Intellectual Property

All content on our website and in our facilities, including but not limited to text, graphics, logos, images, videos, software, and workout programmes, is the property of Lunar Catalyst or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without explicit written permission. The Lunar Catalyst name, logo, and all related marks are trademarks of Lunar Catalyst B.V.

Any feedback, suggestions, or ideas you provide to us regarding our services may be used by Lunar Catalyst without compensation or attribution.

Limitation of Liability

To the maximum extent permitted by Dutch law, Lunar Catalyst's liability for any claims arising from your use of our facilities or services is limited to the amount of membership fees paid by you in the 12 months preceding the incident giving rise to the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.

You acknowledge that physical exercise involves inherent risks of injury, and you assume all risks associated with your participation in fitness activities. This limitation does not apply to liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.

Nothing in these Terms excludes or limits our liability for matters that cannot be excluded or limited under applicable Dutch law.

Indemnification

You agree to indemnify and hold harmless Lunar Catalyst, its officers, directors, employees, and agents from any claims, losses, damages, or expenses (including reasonable legal fees) arising from:

• Your use of our facilities or services
• Your violation of these Terms or applicable laws
• Your negligent or wrongful conduct
• Any injury to third parties caused by your actions

Termination

Termination by Member

You may terminate your membership by providing 30 days' written notice. Termination will be effective at the end of your current billing period. No refunds will be provided for partial months or unused services.

Termination by Lunar Catalyst

We may terminate your membership immediately for breach of these Terms, non-payment of fees, or conduct that we determine to be disruptive or harmful to other members or staff. We may also terminate your membership with 30 days' notice for any reason.

Effect of Termination

Upon termination, your right to access our facilities immediately ceases. You must return any access cards or equipment belonging to Lunar Catalyst. Provisions of these Terms that by their nature should survive termination shall continue in effect.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

By using our services, you consent to the collection and use of your information as described in our Privacy Policy and as necessary to provide our services to you.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence, and nothing in these Terms affects your rights as a consumer under applicable EU consumer protection laws.

We will attempt to resolve any disputes through good faith negotiations. If a dispute cannot be resolved through negotiation, it may be submitted to mediation before resorting to litigation.

Force Majeure

Lunar Catalyst shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, government regulations, or public health emergencies.

In the event of such circumstances, we will make reasonable efforts to notify members and provide alternative arrangements where possible. Membership fees may be adjusted or suspended during extended facility closures beyond our control.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

Entire Agreement

These Terms, together with our Privacy Policy and any additional agreements you may enter into with Lunar Catalyst, constitute the entire agreement between you and us regarding your use of our services and supersede all prior agreements and understandings.

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
